I wanted this name for my business but another company has it in Australia?

I have picked a name for my business and even purchased a domain name. I am in the process of having a website developed and going through all the other legwork. I was doing more research and found on google search if you type in words relating to my store this website in Australia comes up, which is also new.

Should I just change my name?
Even if we kept the same name but live in different countries (this owner did not trademark the name)
isnt it like a constant compeition of who would go to what?

It depends--are your websites in the same market? If they're totally different, having the same name shouldn't be a problem for either company.

Hi... In Australia,  a business name is one thing registered per state, and a company name Pty Ltd is another thing registered Australia wide.  A domain name is another thing.  Trade Marking a Logo and name is another thing.
Go to www.asic.gov.au and check if the Australian company has that name registered.
I wouldn't change the name if I were you.  The only reason your name is not coming up is that your website is not UP yet and you haven't got any ranking.
Once you run a Google campaign like Ad-words then when you do a Google search you will be there.  If you are in UK then your customers will see you ahead of the Australian company.  Google is clever that way.
